Art Commission Terms of Service

T.O.S. for commissioning art from TrashBatChar. Please read before sending a commission request. By sending a request, you are agreeing to the following conditions.
About the Art
✧Do not trace or edit my art without permission.
✧I do not authorize my art to be used in AI or NFT's.
✧Do not remove any watermarks or signatures on the art.
✧If using the commissioned art anywhere (profile icons, stream overlays, etc.), please provide credit when possible.
✧I retain the rights to the art being commissioned and will share it on my social media channels. If you would not like the art to be publicly shared, please discuss with me ahead of time.
✧The art program I use is Procreate, and I tend to work within the default resolutions provided by the program (1536x2048 for full-body characters, 2048x2048 for square canvases). If you need the art done at a specific size or DPI, please let me know ahead of time.
✧I am currently not offering my art for commercial use.
About Commissioning
✧I reserve the right to refuse a commission request for any reason.
✧You must be 18+ to order a commission.
✧Submitting a request via the art commission Google Form is preferred. If you would like to send a commission request via e-mail or Discord message, please make sure to include the following information.
✧Provide as many reference images for the character you are requesting art for as you are able to. This can include a character reference sheet, other examples of art drawn of the character, photo reference of clothing & accessories, pose references and more. Please be as specific as you can, unless you are okay with me taking creative liberties.
✧If you do not have any reference images or you would like me to design a character for you, there will be an additional cost.
✧I will share the sketch WIP with you before proceeding with the rest of the commission. Most revisions must be communicated at this time. Minor adjustments may later be possible, but could require an additional fee depending on complexity.
✧If I make a mistake after the sketch phase and leave out something that you explicitly & clearly communicated, I will fix the issue for free.
Payment
✧Payment methods I accept are Paypal, Cashapp, and Venmo. You may also order through one of my commission storefronts (Ko-Fi or VGen).
✧Payment must be made up front before work on a commission begins. You may ask to be put on a waitlist for no cost, but you will not be moved up in the queue until full payment is received.
✧Refunds will generally only be possible before a sketch has been approved. The amount refunded will depend on how much work was already put into the canceled commission.
Deadlines & Delivery
✧Commissions are usually worked on in the order in which I receive them. You may check where you are in the queue on my Trello.
✧If you need the commission finished by a certain date, please say so up front. There may be a rush fee for particularly short deadlines.
✧If there are any significant delays on my end, I will do my best to communicate them with you.
✧When the art is completed, you will receive it in PNG form by default, but JPEG or other file types can be provided upon request.
Adoptable Design TOS
✧Please credit me as the artist of the design (TrashBatChar).
✧Payment must be received in full, up front. PayPal/Venmo/Cashapp, or purchase on ko-fi.
✧Once paid, you will receive PNG’s of the design without watermarks.
✧Gifting, trading, and re-selling is allowed. You may NOT sell for more than what you paid for.
✧If gifting/trading/selling, please contact me & inform me of the new owner. The new owner must also follow these rules.
✧My designs are currently only for personal use. If you would like to request commercial use, please contact me to discuss.
✧You may change details of the design in subsequent drawings, but please do not edit the original art.
✧I can use the art of the design in my online galleries/portfolios such as deviantArt and Toyhouse.
