Art Commission Terms of Service

T.O.S. for commissioning art from TrashBatChar. Please read before sending a commission request. By sending a request, you are agreeing to the following conditions.
About the Art
✧Do not trace or edit my art without permission.
✧I do not authorize my art to be used to train AI or be replicated by AI in any way.
✧If using the commissioned art anywhere (profile icons, stream overlays, etc.), please provide credit when possible.
✧Unless a privacy fee is paid, I will be able to post the commissioned art to my social media channels to advertise my services.
✧Commercial use rights may be requested for purchase & would allow you to sell merchandise with the art you commissioned. Commercial use fees are determined on a case-by-case basis, but generally will be about 100-200% of the base cost of the commission.
✧The art program I use is Procreate, and I tend to work within the default resolutions provided by the program. If you need the art done at a specific size or DPI, please let me know ahead of time.
About Commissioning
✧I reserve the right to refuse a commission request for any reason.
✧You must be 18+ to order a commission.
✧Requests can be made through through VGen or Ko-fi, or by DM'ing me on Discord.
✧Please provide as many reference images for the character you are requesting art for as you are able to. This can include a character reference sheet, other examples of art drawn of the character, photo reference of clothing & accessories, pose references and more. Please be as specific as you can, unless you are okay with me taking creative liberties. I do not accept AI-generated images as reference.
✧If you do not have any reference images or you would like me to design a character for you, there will be an additional cost to account for research and design work.
✧Except for some YCH options, I will share the sketch WIP with you before proceeding with the rest of the commission. Most revisions must be communicated at this time. Adjustments may later be possible, but could require an additional fee depending on complexity. Character reference sheets will have space for several revisions built into the price. If I make a mistake after the sketch phase and leave out something that you explicitly & clearly communicated, I will fix the issue for free.
✧Most refunds will only be possible before a sketch has been approved. The amount that is able to be refunded will depend on how much work was already put into the canceled commission.
Payment
✧Payment methods I accept are Paypal, Cashapp, and Venmo. You may also order through one of my commission storefronts: VGen or Ko-Fi.
✧Payment must be made up front before work on a commission begins. You may ask to be put on a waitlist for no cost, but you will not be moved up in the queue until full payment is received. Payment plans for bigger commissions are possible through VGen & may be offered on a case-by-case basis outside of the platform.
✧Refunds will typically only be possible before a sketch has been approved. The amount refunded will depend on how much work was already put into the canceled commission.
Deadlines & Delivery
✧Commissions are generally worked on in the order in which I receive them. You may check progress on my Trello. DM's asking for an updated ETA are okay, but please do not ask excessively.
✧If you need the commission finished by a certain date, please communicate this up front. A rush fee may be offered for projects with an extremely short deadline.
✧If there are any significant delays on my end, I will do my best to communicate them with you.
✧You will receive the final art files as PNG's (& GIF's when applicable). PSD files or layers may be requested & considered on a case-by-case basis.
